doit donner toute l&#x2019;information qu&#x2019;elle d&#xE9;tient en mati&#xE8;re d&#x2019;environnement &#xE0; toute personne qui la lui demande (sans que cette personne ait &#xE0; justifier son identit&#xE9; ni du pourquoi de la demande). Toutefois, l&#x2019;acc&#xE8;s peut en &#xEA;tre restreint dans le cadre de nuisances aux relations internationales, &#xE0; la s&#xE9;curit&#xE9; publique ou &#xE0; la d&#xE9;fense nationale. Dans cette directive, les &#xE9;tats sont aussi consid&#xE9;r&#xE9;s comme des collectivit&#xE9;s.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #444444;\"><span style=\"font-family: 'Franklin Gothic Book', 'Franklin Gothic Book', sans-serif;\"><span style=\"font-size: medium;\">La France s&#x2019;est engag&#xE9;e &#xE0; double titre dans la transcription des principes d&#x2019;Aahrus. Tout d&#x2019;abord, en tant que signataire directe, cette convention internationale a, une fois publi&#xE9;e, une valeur infra constitutionnelle et supra l&#xE9;gislative. La convention d&#x2019;Aarhus, approuv&#xE9;e par la loi n&#xB0;2002-285 du 28 f&#xE9;vrier 2002 puis annex&#xE9;e au d&#xE9;cret de publication du 12 septembre 2002, est donc entr&#xE9;e en vigueur le 6 octobre 2002.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #444444;\"><span style=\"font-family: 'Franklin Gothic Book', 'Franklin Gothic Book', sans-serif;\"><span style=\"font-size: medium;\">Cette convention internationale contient des dispositions d&#x2019;effet direct, c&#x2019;est &#xE0; dire qui peuvent &#xEA;tre directement invoqu&#xE9;es devant les tribunaux fran&#xE7;ais sans qu&#x2019;une int&#xE9;gration dans la l&#xE9;gislation soit n&#xE9;cessaire.<\/span><\/span><\/span><\/p>\n<ol>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #444444;\"><span style=\"font-family: 'Franklin Gothic Book', 'Franklin Gothic Book', sans-serif;\"><span style=\"font-size: medium;\">En mati&#xE8;re de droit &#xE0; l&#x2019;information, le d&#xE9;lai de r&#xE9;ponse au citoyen demandeur est d&#x2019;un mois, alors que le r&#xE8;glement fran&#xE7;ais accorde 2 mois.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #444444;\"><span style=\"font-family: 'Franklin Gothic Book', 'Franklin Gothic Book', sans-serif;\"><span style=\"font-size: medium;\">L&#x2019;acc&#xE8;s &#xE0; un document peut &#xEA;tre refus&#xE9; lorsqu&#x2019;un secret de fabrication est prot&#xE9;g&#xE9; par la loi pour d&#xE9;fendre un int&#xE9;r&#xEA;t &#xE9;conomique l&#xE9;gitime.<\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #444444;\"><span style=\"font-family: 'Franklin Gothic Book', 'Franklin Gothic Book', sans-serif;\"><span style=\"font-size: medium;\">Toutefois dans ce cadre, des informations sur les &#xE9;missions qui sont pertinentes pour la protection de l&#x2019;environnement doivent &#xEA;tre divulgu&#xE9;es. Or la commission d&#x2019;acc&#xE8;s aux documents administratifs (CADA) a toujours refus&#xE9; la communication au public de relev&#xE9;s individualis&#xE9;s d&#x2019;analyse d&#x2019;effluents d&#x2019;une usine car ils pouvaient r&#xE9;v&#xE9;ler des proc&#xE9;d&#xE9;s de fabrication. (CADA 29 novembre 1984 Cl&#xE9;ment).
